Cablan.net offers no explicit warranties or otherwise. We do not garantee the uptime, speed or availability of our servers. Furthermore, we cannot garantee that our servers or plans will conform to our advertisemens or to your needs.
However, your satisfaction is our primary concern, and we will always do everything in our capacity to satisfy your needs. In the case that you have specific needs, please contact us before ordering to make sure we are able to fulfill them.
Our hosting plans are usually based on an annual payment. The first year is paid prior to activation. 1 month prior to renewal, you will be sent an invoice by email. Failure to pay prior to the renewal date we will cancel your account. We will never automatically charge your credit card.
If you choose to pay your hosting plan on a monthly basis, within your first month, you will receive 2 invoices. Since we invoice on the actual day of your initial order but generate invoices once per month, one will cover your second month, due almost immediatly and the other will cover your third month and is generated in advance for your convenience.
If a hosting account is suspended for non-payment, an unsuspension fee of up to 30$ CAD may be invoiced prior to restoration of the account. This fee may be required even if the unsuspension is only performed to allow transfer to another hosting company.
If a domain name is renewed pending a payment, regardless if a promise to pay or not was made by the client, an additional renewal fee may be invoiced of up to 30$ CAD or the actual cost of the domain name, whichever is higher.
If an invoice is paid late, an annual interest rate of up to 24% may be added, at a monthly rate of 2% on the original invoice amount. Invoices generated before April 3rd 2008 only generate interest from April 3rd 2008.
If a client whishes to upgrade to an higher account, he must pay for a year of the new account minus the unused part of his previous account, rounded to the nearest day.
Cablan.net declines responsability for any loss including data, services or revenus whether Cablan.net was responsable or not.By accepting to pay for an hosting account, the client acknowledges that he has read and accepted our Terms of Services and does not hold Cablan.net responsable even in a case of negligence.This agreement is governed by and interpreted under the laws of the province of Québec, Canada. as such laws are applied to agreements entered into and to be performed entirely within Québec by Québec residents.Any arbitration or litigation relating to the relationship between Cablan.net and it's clients shall settled in Québec, according to Québec laws.
The French version of this document takes priority over the English version and any discrepencies between the two versions shall be ignored and the French version used.If any clause of this contract be invalidated in a court of law, only this clause of the contract shall be invalidated and not the whole contract.
Cablan.net may unilateraly cancel the account of a client in the event that he is suspected of violating the Terms of service or the Acceptable usage policy of Cablan.net.Such termination may be conducted without any warning and any financial compensation.If this termination occurs, the client agrees not to contest the cancellation in a court of law or in arbitration.
The client also agrees to keep confidential it's former relationship with Cablan.net and never to mention in public the fact that he was cancelled, whether it was justified or not.
